1. Definitions
In this Agreement:
- "Car" or "Vehicle" means the motor vehicle described in the Rental Agreement, including all accessories, equipment, and documents.
- "Calendar Day" means any 24-hour period commencing from the pickup time stated in the Rental Agreement.
- "Permitted Driver" means the Renter and any additional driver(s) aged 25 years or older who are named in the Rental Agreement and hold a valid driver's license.
- "Full-Pay Option" means the prepaid fuel option where the Renter pays for a full tank at pickup and may return the vehicle at any fuel level.
- "LDW" or "Loss Damage Waiver" means the optional Enhanced Insurance product that reduces the Renter's financial exposure for damage to the Vehicle.
2. Rental Agreement
The Rental Agreement between you ("Renter") and RevyCar Rentals ("Company", "we", "us") consists of:
- The Rental Agreement form signed at vehicle pickup;
- These Terms and Conditions;
- Any supplementary documents, addenda, or written amendments.
By signing the Rental Agreement or taking possession of the Vehicle, you acknowledge that you have read, understood, and agree to be bound by all terms herein.
3. Eligibility & Licence Requirements
To rent a Vehicle, the Renter must:
- Be at least 25 years of age;
- Hold a valid, unrestricted driver's license for a minimum of 2 years;
- Present the original driver's license at pickup (copies or digital images not accepted);
- If the license is not in English, present an International Driving Permit (IDP) or official certified translation;
- Provide a valid credit card in the Renter's name for security deposit;
- Foreign visitors must also present a valid passport or travel document.
We reserve the right to refuse rental to anyone who does not meet these requirements or whose license appears invalid, suspended, or restricted.
4. Deposits, Payment & Authorizations
Credit Card: A valid credit card is required for all rentals. We will place a pre-authorization hold on your credit card at pickup. The hold amount varies based on the Vehicle class and rental duration.
Debit Card: Debit cards are accepted with a $300 additional deposit on top of the rental fees. This deposit is refunded after the Vehicle is returned in satisfactory condition.
Chargeback Policy: If you initiate a chargeback dispute for legitimate charges, we reserve the right to pursue collection, report the account to credit agencies, and charge administrative fees of up to $250.
5. Cancellation & Refund Policy
- 48+ hours before pickup: Full refund of prepaid amounts.
- Within 48 hours of pickup: One calendar day's rental charge retained; balance refunded.
- No-show: Full rental amount charged with no refund.
- One-way fees: Non-refundable once the Vehicle has departed the pickup location.
- Early return: No refund for unused rental days. The full agreed rental period is charged.
All reservation changes must be confirmed in writing (email) by RevyCar Rentals. Verbal modifications are not binding.
6. Vehicle Availability
If the specific Vehicle reserved is unavailable at pickup, we will:
- Provide a comparable or upgraded Vehicle at no additional cost; or
- Arrange delivery of your reserved Vehicle from another location within a reasonable timeframe; or
- Provide a full refund if no suitable alternative exists.
Trip Interruption: We are not liable for any consequential damages arising from Vehicle unavailability, breakdown, or trip interruption, including but not limited to missed flights, hotel bookings, or event tickets.
7. Self-Serve Pickup & After-Hours Return
Self-Serve Pickup: Available 24/7. You will receive access codes and vehicle location instructions via email and SMS. You are responsible for:
- Inspecting the Vehicle and documenting existing damage with photos/video;
- Reporting any pre-existing damage within 2 hours of pickup;
- Ensuring the Vehicle is suitable for your intended use before departing.
After-Hours Return: Return the Vehicle to the designated location, secure all doors and windows, and follow lock-box key return instructions. The rental period ends when we inspect the Vehicle during the next business day.
8. Rental Period & Late Return
The rental period begins at the pickup time and ends at the scheduled return time stated in your Rental Agreement.
Grace Period: A 3-hour grace period is provided for late returns. Beyond the grace period, an additional full calendar day's rental charge applies at the daily rate.
Significantly late returns without prior arrangement may result in the Vehicle being reported as missing to authorities.
9. Mileage & Fuel
Included Kilometres: Each calendar day includes 200 km. Daily allowances are pooled for multi-day rentals. Additional kilometres are charged at $0.19/km.
Fuel Policy: Vehicles are provided with a full tank. Return the Vehicle with a full tank to avoid:
- Refueling charge at current market rate; plus
- $20 refueling service fee.
Alternatively, the Full-Pay Option allows you to prepay for a full tank at pickup and return at any fuel level.
10. Rates, Taxes & Fees
All rates are quoted in Canadian Dollars (CAD) and exclude:
- Applicable federal and provincial taxes (GST/PST);
- Airport/location surcharges where applicable;
- One-way fees for different pickup/return locations;
- Optional equipment and add-ons;
- Enhanced Insurance/LDW if elected.
Cleaning Fee: Vehicles returned requiring excessive cleaning will be charged a minimum $75 cleaning fee.
Smoking/Vaping Fee: Up to $1,000 for evidence of smoking or vaping in the Vehicle.
11. Insurance & Loss Damage Waiver
Standard Coverage: All rentals include $10,000,000 third-party liability insurance as required by law.
Renter Responsibility: You are responsible for:
- Collision damage: $2,500 deductible;
- Comprehensive damage (theft, vandalism, weather): $300 deductible.
Enhanced Insurance (LDW): For $15/day, reduce your exposure to $300 collision / $0 comprehensive. Subject to policy terms and eligibility.
Declining Coverage: If you decline Enhanced Insurance, you must provide proof of valid rental car coverage from your personal auto insurance, credit card, or travel insurance provider.
Coverage Priority: Credit card and third-party insurance applies first. Any excess or uncovered amounts are your responsibility.
12. Windscreen, Tire & Rim Damage
The following charges apply regardless of fault or insurance:
- Windscreen replacement: Up to $1,500
- Tire replacement: Up to $500 per tire
- Rim replacement: Up to $750 per rim
Enhanced Insurance may reduce these exposures. Check your policy for details.
13. Roadside Assistance & Towing
24/7 roadside assistance is provided through the Vehicle manufacturer's program (Toyota, Ford, or Kia Roadside Services).
Covered: Mechanical breakdown, flat battery, lost keys (first occurrence), flat tire change.
Not Covered (Renter pays): Towing due to accidents, driver error, or misuse; fuel delivery; lockouts due to lost/damaged keys (subsequent occurrences); towing from prohibited locations.
14. Mechanical Failure
Manufacturer defect or normal wear: We are responsible for repair costs and will arrange alternative transportation or refund unused rental days.
Renter-caused damage: You are responsible for all repair costs arising from misuse, neglect, or operation contrary to the owner's manual (e.g., wrong fuel type, ignoring warning lights, overloading).
15. Accidents & Collisions
In the event of an accident, you must:
- Ensure the safety of all persons involved;
- Call emergency services if there are injuries;
- Do not admit fault to any party;
- Exchange information with other parties (name, contact, license, insurance);
- Take photos of all vehicles, damage, and the scene;
- File a police report if required by law;
- Notify RevyCar Rentals within 24 hours at +1 250-814-6000;
- Complete and submit an Accident Report Form.
Hit-and-Run: If the Vehicle is damaged in a hit-and-run, you must file a police report within 24 hours. Failure to file results in full liability for damages.
16. Prohibited Uses
The Vehicle may not be used:
- By any person other than a Permitted Driver;
- While the driver is under the influence of alcohol, drugs, or medication affecting driving ability;
- For any illegal purpose;
- To tow or push any vehicle, trailer, or object;
- Off paved public roads (includes logging roads, beaches, trails);
- To cross international borders without prior written consent;
- For racing, competitions, driver training, or speed testing;
- To transport hazardous, toxic, or flammable materials;
- For commercial purposes (taxi, rideshare, delivery, hire);
- If dashboard cameras or telematics devices are tampered with, obscured, or disabled.
17. Misuse & Equipment Fees
The following fees apply for violations:
- Unauthorized driver: $500 + full liability for any damage;
- Off-road use: $500 + damage costs;
- Border crossing without consent: $1,000;
- Dash cam/telematics tampering: $500;
- Lost keys: $350 per key;
- Lost/damaged documents: $75.
18. Traffic, Parking & Toll Violations
You are responsible for all traffic violations, parking tickets, and toll charges incurred during the rental period. If we receive such notices:
- We will forward them to you or provide your details to authorities;
- A $50 administrative fee applies per violation processed;
- Unpaid violations will be charged to your card on file.
19. Collections & Interest
Amounts owing that remain unpaid for 30 days will accrue interest at 1.5% per month (18% annually). Accounts referred to collections will incur a $150 administrative fee plus all collection costs.
20. Telematics & Dash Cameras
Vehicles may be equipped with GPS tracking, telematics, and interior/exterior dash cameras for:
- Vehicle security and theft recovery;
- Insurance documentation;
- Fleet management and maintenance;
- Dispute resolution.
By accepting this Agreement, you consent to the collection, use, and storage of device data including location, speed, acceleration, braking, and video/audio recordings. This data may be shared with law enforcement, insurers, or legal representatives as required.
21. Governing Law & Dispute Resolution
This Agreement is governed by the laws of British Columbia, Canada. Any disputes arising from this Agreement shall be resolved through binding arbitration conducted in Revelstoke, BC, in accordance with the Arbitration Act of British Columbia.
Both parties waive the right to participate in class actions and the right to trial by jury.
Severability: If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force and effect.
Assignment: We may assign our rights and obligations under this Agreement. You may not assign yours without our written consent.
Amendments: These Terms may be updated from time to time. The version in effect at the time of your rental applies.
