RevyCar Rentals Inc. — Effective February 2026 (supersedes all prior versions)

Part I — General

1. Rental Agreement

These Terms & Conditions, together with the Rental Contract, any electronic or paper addenda, the Privacy Notice and the Rental Receipt, form the complete "Rental Agreement" between you ("Renter") and REVYCAR RENTALS INC. ("RevyCar," "we," "our"). No verbal statement is part of this Agreement.

2. Definitions

Car — the specific motor vehicle provided plus keys/fobs, licence plates, tires, tools, documents, on-board telematics devices, fuel and any accessories rented with it, including dash-cam hardware.

Calendar Day — any part of a day ending 23:59 local time.

Permitted Driver — the Renter, the Renter's spouse or domestic partner, or — when rented on a corporate account — an employee or colleague whose use is incidental to business duties, provided each driver is ≥ 21 years old and holds a valid driver's licence in good standing.

Full-Pay Option — the Renter's election to pre-pay the entire rental at least 48 hours before scheduled pick-up in exchange for a 15% discount and a strict no-refund condition. If Full-Pay is selected within 48 hours of pick-up, the discount is automatically revoked and standard booking terms apply.

Self-Serve Pick-Up — RevyCar's contactless vehicle pick-up process by which the Renter takes possession of the Car without in-person staff assistance, using instructions provided electronically.

Force Majeure — any event beyond the reasonable control of the affected party, including but not limited to: acts of God, flood, fire, earthquake, avalanche, epidemic or pandemic, government orders or restrictions, highway closures, labour disputes, power failure, internet or telecommunications outage, or acts of war or terrorism. Neither party is liable for failure to perform obligations due to Force Majeure, provided the affected party gives prompt notice.

Young Driver — a Permitted Driver aged 21–24 (inclusive). A Young Driver Surcharge of C$25 per Calendar Day applies.

3. Renter Representations & Warranties

By signing the Rental Contract or completing the Self-Serve Pick-Up process, the Renter represents and warrants that:

  1. all information provided to RevyCar is true, accurate and complete;
  2. each Permitted Driver holds a valid, unrestricted driver's licence appropriate for the class of Car rented;
  3. no Permitted Driver is under the influence of alcohol, drugs, or any medication that impairs driving ability at the time of pick-up;
  4. no Permitted Driver has had their licence suspended or revoked in the past 3 years;
  5. the Renter has the legal capacity and authority to enter into this Agreement; and
  6. the Renter has read and understood these Terms & Conditions in their entirety.

Part II — Reservations & Cancellations

4. Deposits, Cancellation & Refunds

A C$50 deposit is required for every reservation unless the Full-Pay Option is selected. Refundability depends on cancellation timing:

  • ≥ 7 days before pick-up (Standard): Deposit fully refunded
  • Within 48 hours (Standard): Deposit retained
  • < 24 hours (Standard): Deposit retained
  • Full-Pay Option: Non-refundable regardless of timing

One-way delivery fees are non-refundable if the booking is cancelled < 3 days before pick-up and 50% refundable if cancelled 4–14 days out.

Full Payment Timing: RevyCar requests full payment 48–72 hours prior to the Scheduled Pick-Up Time. If the Renter cancels or fails to pick up the Car after full payment has been collected:

  • Peak Season (Jun–Sep, Dec–Apr): No refund. Full amount forfeited.
  • Off-Peak Season (Oct–Nov, May): No cash refund. RevyCar may, at its sole discretion, offer a partial refund or credit toward a future booking (valid 12 months, non-transferable, no cash value).

5. No-Show Policy

A "No-Show" occurs when:

  1. the Renter fails to take possession at the Scheduled Pick-Up Time without contacting RevyCar;
  2. the Renter fails to complete the Self-Serve Pick-Up process; or
  3. the Renter does not possess or cannot operate a smartphone meeting the minimum requirements (cellular data, SMS, camera, GPS).

If no contact is made within 2 hours after the Scheduled Pick-Up Time, the reservation is automatically deemed a No-Show Without Prior Notification and RevyCar may release the Car.

Financial consequences: Standard bookings forfeit the deposit. Full-Pay bookings forfeit the entire pre-paid amount. One-way delivery fees are non-refundable in addition.

A No-Show does not automatically create a new reservation. No credit is applied from the forfeited booking. RevyCar is not responsible for the cost of alternative rentals or any consequential losses.

6. Vehicle Abandonment

The Car is deemed abandoned if:

  1. it is not returned by the end of the rental period and the Renter has not contacted RevyCar within 24 hours of the scheduled return time; or
  2. the Car is found unattended outside a RevyCar designated return point with no indication the Renter intends to continue the rental.

RevyCar may use telematics/GPS to locate the Car, engage towing, or report it as stolen. A C$500 abandonment administrative fee applies plus all recovery costs, loss-of-use, and damage. Abandonment voids all optional coverages. Personal property left in an abandoned Car will be held for 30 days.

7. Early Return

Returning the Car early does not guarantee a refund. When granted at RevyCar's sole discretion, refunds are capped at 50% of unused days.

Blackout Periods: Refunds are never offered for returns between 1 June–30 September or 1 December–30 April. For early returns of 3+ unused Calendar Days during a blackout period, RevyCar will issue a credit equal to 25% of the value of the unused days, redeemable toward a future booking within 12 months. Credits are non-transferable and have no cash value.

8. Vehicle Availability Remedy

If RevyCar cannot supply the confirmed vehicle class (other than for Force Majeure), the Renter may choose:

  1. a free upgrade; or
  2. delivery of a comparable vehicle within 4 hours; or
  3. a full refund of all amounts paid.

9. Reservation Changes

Changes are valid only when confirmed in writing by an authorised RevyCar officer. Revised charges and terms become part of this Agreement.

10. Trip Interruption

RevyCar is not liable for missed flights, connections, events or consequential costs caused by vehicle unavailability, breakdown or any other circumstance beyond our control.

Part III — Vehicle Supply & Use

11. Self-Serve Pick-Up & After-Hours Returns

Minimum Requirements: A smartphone with active cellular data, SMS/text capability, functioning camera, and location services (GPS) enabled. Non-negotiable.

Self-Serve Instructions: Provided via email/SMS prior to pickup, including vehicle location, access method (lock-box, digital key, etc.), and mandatory vehicle condition inspection steps.

Vehicle Condition Inspection: Before departing, complete a photo/video inspection of the Car's exterior (all four sides, roof, wheels) and interior. Failure to complete creates a presumption that the Car was received in RevyCar's documented condition.

Technical Failure: If the Self-Serve system fails on RevyCar's side (confirmed outage), we will facilitate an alternative pick-up within 4 hours. Failures on the Renter's side (device, carrier, connectivity, user error) are treated as a No-Show.

After-Hours Returns: Park in the designated area, complete photos/video inspection, secure keys as instructed, and confirm the return. Responsibility remains with the Renter until RevyCar inspects the Car during the next business day.

In-Store Alternative: Renters not comfortable with Self-Serve are encouraged to schedule pickup/drop-off during office hours (Mon–Fri 11 AM–5 PM, Sat 11 AM–4 PM).

Stand-By Support: Optional service for C$35. A team member will be available by phone for 1 hour from the Scheduled Pick-Up Time. Non-refundable once pickup time has passed. Must be requested 24+ hours in advance, subject to availability.

12. Permitted Drivers & Licence Verification

We may verify licence validity at any time and may refuse or terminate the rental if credentials are invalid. All Permitted Drivers must be identified on the Rental Contract before operating the Car.

Young Driver Surcharge: Permitted Drivers aged 21–24 are subject to a surcharge of C$25 per Calendar Day. The surcharge applies for each day a Young Driver is listed, regardless of whether they actually operate the Car on that day.

13. Vehicle Return Condition

The Renter must return the Car in substantially the same condition as received, specifically:

  1. all keys/fobs, documents, accessories, and dash-cam equipment must be returned;
  2. the interior must be free of excessive soil, debris, pet hair, food waste, and odours;
  3. the Car must be returned to the designated return location on the Rental Contract.

Part IV — Charges & Fees

14. Rental Period & Late Return

One rental day = 24 hours from the time on the Rental Contract.

  • Grace Period: 60 minutes after the scheduled return time, at no additional charge.
  • Hourly Charges: From 61 minutes to 4 hours past return, C$15 per commenced hour.
  • Full Day Charge: More than 4 hours past return = additional full rental day at the prevailing daily rate.

Repeated late returns may result in RevyCar declining future reservations.

15. Included Kilometres & Overage

  • 200 km per Calendar Day, 1,000 km per 7-day rental, 3,500 km per 30-day rental.
  • No distance package: excess distance charged at C$0.35/km.
  • With distance package: km beyond the package limit charged at C$0.19/km.
  • Odometer or telematics tampering results in the maximum weekly allowance plus 50% surcharge.

16. Rates, Taxes, Surcharges & Miscellaneous Fees

The Renter pays all rental charges, taxes, airport/facility fees, surcharges, cleaning fee (C$150 for excessive soil), smoking/vaping fee (C$250–1,000), key replacement, Young Driver Surcharge (C$25/day), and any other amounts shown on the Rental Contract or Schedule of Fees.

17. Fuel

Rentals normally start full. Options:

  1. return full;
  2. pre-pay fuel at quoted rate;
  3. pay fuel service charge of C$9.99 plus C$0.22/L above prevailing local price if returned short.

18. Payment Hold, Authorisation & Charge-Back

The Renter authorises RevyCar to place a hold on the payment card for the estimated rental amount and to charge that card for additional charges including traffic fines, damages, loss-of-use, towing, diagnostics, administrative fees and interest.

Post-Rental Charges: For charges exceeding C$100 that arise after the rental period, RevyCar will provide written notice by email at least 5 business days before charging the card.

Returned payments or charge-backs incur a C$35 administrative fee plus collection costs.

Part V — Insurance, Damage & Roadside

19. Loss Damage Waiver (LDW) & Insurance

LDW is optional, not insurance, and limits liability for physical damage to the deductible shown on the Rental Contract (standard C$2,500).

If LDW is declined, the Renter must maintain insurance meeting statutory automobile requirements and covering collision and liability. Proof is required before pick-up.

BC Residents: Ensure your ICBC Autoplan basic coverage extends to rental vehicles, or purchase additional coverage. Out-of-province and international renters must verify their insurance extends to rental vehicles operated in British Columbia, Canada.

20. Damage, Windscreen & Tire Schedule

  • Windscreen replacement: C$300
  • Windscreen chip repair: C$40 per chip
  • Tire replacement: C$250 + replacement cost
  • Rim curb-rash > 50 mm: C$100

Charges are in addition to loss-of-use, towing and administrative fees.

21. Roadside Assistance & Towing

If the Renter has not purchased the optional Roadside Assistance Plan and a call-out results from Renter fault (fuel depletion, battery drain, mis-fuelling, off-road incident, stuck in sand/snow), we will tow the Car to the nearest franchised dealership for diagnostics. If negligence is confirmed, the Renter is liable for: actual dealership costs, towing/transportation charges, loss-of-use at the prevailing daily rate, and a C$75 administrative fee.

22. Mechanical Failure Policy

Replacement Vehicle: For mechanical failures not caused by the Renter, RevyCar will supply a comparable or upgraded vehicle at no additional charge.

No-Cost Towing & Repair: Verified mechanical failures outside the Renter's control do not incur towing, diagnostic or repair costs.

Renter-Liable Incidents: Mis-fuelling, operation with low/no fluids, continued driving after warning lights, clutch/gearbox abuse, overheating from improper towing, undercarriage impact damage.

Deductible Authorisation: Where preliminary assessment suggests renter fault, a C$2,500 deductible hold will be placed pending the dealership report. If negligence is confirmed, the hold converts to payment; if not, it is released in full.

23. Accident & Collision Policy

Immediate Actions:

  1. Ensure personal safety and dial 9-1-1 if necessary.
  2. Where damage exceeds C$2,000, any party is injured, or a third-party vehicle is involved, notify police and obtain a file number.
  3. Exchange names, phone numbers, driver-licence details, plate numbers and insurance particulars; take timestamped photos; record witness information.
  4. Within one (1) hour, telephone RevyCar at +1 250-814-6000 and email info@revycar.ca. Written Accident Report must be completed within 24 hours.
  5. Do not admit liability, negotiate or settle claims without RevyCar's written consent.

Hit-and-Run: Fleeing an accident or failing to report renders all coverages void. The Renter is fully liable plus a C$750 hit-and-run administrative fee and legal expenses.

Unauthorized Driver: If the driver is not a Permitted Driver, all coverages are void and the Renter is fully liable for the entire loss.

Total Loss: A vehicle is a total loss when repair plus salvage exceeds 70% of the Actual Cash Value (ACV). ACV is determined by Canadian Black Book values, regional sales data, and/or independent appraisal.

Part VI — Use Restrictions & Penalties

24. Prohibited Uses

The Vehicle may not be used:

  • By an unauthorised driver;
  • To carry passengers or goods for hire;
  • To tow or push;
  • In a race, test, or off-road;
  • While impaired;
  • For criminal activity;
  • Recklessly or overloaded;
  • To cross an international border without prior written consent;
  • With dash-cam hardware removed or disabled (voids LDW, terminates the rental);
  • For driver training or instruction;
  • To transport hazardous, explosive, corrosive, or illegally obtained materials;
  • For subleasing, re-renting, or sharing through any platform (Turo, Getaround, rideshare, etc.).

24A. Cross-Border Travel

US travel requires prior written consent. Request approval 48+ hours in advance with intended US destinations, dates, and confirmation that insurance extends to the US. A cross-border fee may apply. RevyCar's LDW does not extend outside Canada unless expressly stated in the authorisation letter.

24B. Pet Policy

Pets are not permitted without prior written consent. If approved: pet must be in a carrier or harness at all times. Minimum C$250 pet cleaning fee for hair/odour, plus any damage charges. Transporting a pet without consent incurs the cleaning fee plus the applicable misuse fee.

24C. Accessories & Roof Equipment

RevyCar may offer Thule roof boxes, ski/snowboard racks, bike racks, and cargo carriers. By accepting an Accessory, the Renter represents competency in its use. The Renter must observe all height restrictions and not exceed the manufacturer's weight capacity.

Damage Charges:

  • Thule roof box minor damage: C$150–400
  • Thule roof box major damage/total loss: C$600–1,200
  • Rack/mounting system damage: C$200–500
  • Overhead clearance impact: Full repair cost for vehicle + accessory + loss-of-use

RevyCar is not responsible for items stored inside roof boxes or on racks.

25. Misuse & Equipment Fee Schedule

Fees are additive to damage, towing, loss-of-use and administrative charges:

  • Unauthorised off-road use: C$500
  • Burnouts / drifting evidence: C$300
  • Telematics tampering: C$750
  • Border crossing without consent: C$250
  • Smoking or vaping: C$250–1,000
  • Dash-cam missing: C$300
  • Dash-cam accessories missing: C$40 per item
  • SD card missing: C$100
  • Dash-cam or SD card tampering: C$35
  • Unauthorised pet: C$250 + cleaning costs
  • Driver training / instruction use: C$500
  • Subleasing / re-renting / ride-sharing: C$1,000

Part VII — Fines, Collections & Administration

26. Traffic, Parking & Toll Violations

The Renter is liable for all fines, penalties and tolls. If payment is not received within 14 days of written notice, RevyCar may charge the card on file for the fine plus C$50 per violation.

27. Additional Costs & Collections

Unpaid balances accrue interest at 1.5% per month (19.6% per annum) or the maximum lawful rate, whichever is lower. The Renter pays all reasonable attorney, collection and administrative fees.

28. Personal Property Disclaimer

RevyCar is not responsible for personal property left in the Car. Items found in returned vehicles will be held for 14 days; after that, RevyCar may dispose of them without liability.

Part VIII — Data, Telematics & Privacy

29. Connected-Car Data & Dash-Cam Policy

Many Cars are equipped with GPS-enabled telematics and a forward-facing dash-cam powered via the 12V outlet and/or fusebox. The dash-cam records continuously while the ignition is on. The Renter may not remove, unplug, cover or disable the dash-cam, its cables, mount, adaptor or SD card. Recorded footage may be used for safety, insurance or dispute resolution.

30. Mobile Device Data

If the Renter pairs a personal device with the Car's infotainment system, it is the Renter's responsibility to delete personal data on return. RevyCar accepts no liability for residual data.

31. Privacy & Data Protection

RevyCar collects, uses, and discloses personal information in accordance with the Personal Information Protection Act (British Columbia) and PIPEDA (Canada). Full details are in our Privacy Notice at revycar.ca/privacy.

Part IX — Seasonal & Environmental

32. Winter Tires & Seasonal Equipment

From October 1 through April 30, all Cars are equipped with tires meeting the 3-Peak Mountain Snowflake (3PMSF) standard as required by the BC Motor Vehicle Act. The Renter acknowledges that winter driving conditions may exist regardless of season, and agrees to use tire chains where required by posted signage. Damage from failure to install chains where required is the Renter's responsibility.

Part X — Legal Provisions

33. Indemnification

The Renter shall indemnify and hold harmless RevyCar, its officers, directors, employees, and agents from all claims, damages, losses, liabilities, costs, and expenses arising from the Renter's use of the Car, any breach of this Agreement, prohibited uses, injury or damage caused, or violation of applicable law. This indemnification survives termination of the Agreement.

34. Limitation of Liability

RevyCar's total aggregate liability shall not exceed the total rental charges paid for the applicable rental period. In no event shall RevyCar be liable for indirect, incidental, special, consequential, or punitive damages. This does not limit liability for death or personal injury caused by RevyCar's negligence, or for fraud.

35. Governing Law & Dispute Resolution

This Agreement is governed by the laws of British Columbia, Canada. Parties will attempt good-faith negotiation for 30 days. Unresolved disputes may be commenced in the courts of British Columbia, with venue in Kelowna, BC. Claims under C$5,000 may use the BC Civil Resolution Tribunal (CRT).

Consumer Protection: Nothing in this section limits any rights the Renter may have under the Business Practices and Consumer Protection Act, S.B.C. 2004, c. 2.

36. Electronic Communications & E-Signature Consent

The Renter consents to receive all communications from RevyCar electronically. Electronic signatures and confirmations have the same legal effect as handwritten signatures under the Electronic Transactions Act, S.B.C. 2001, c. 10.

37. Severability & Waiver

If any term is held unenforceable, the remainder remains effective. A waiver of any breach is not a waiver of subsequent breaches.

38. Assignment

RevyCar may assign its rights or obligations under this Agreement with 30 days' notice. No assignment will increase the Renter's obligations. The Renter may not assign this Agreement.

39. Entire Agreement & Amendments

This document, the Rental Contract and the Privacy Notice constitute the entire Agreement and may be amended only by written instrument signed by an authorised RevyCar officer, or by RevyCar posting revised Terms at rent.revycar.ca, which will govern rentals booked thereafter.

40. Co-operation

The Renter will co-operate fully with RevyCar in any investigation, claim or proceeding arising from this Agreement.

41. Survival

The following provisions survive expiry or termination: §3 (Representations), §5 (No-Show), §6 (Abandonment), §18 (Payment), §19–23 (Insurance, Damage & Accident), §24–24C (Restrictions, Accessories & Fees), §25–27 (Fees & Collections), §28 (Personal Property), §29–31 (Data & Privacy), §33 (Indemnification), §34 (Limitation of Liability), §35 (Governing Law), and §40 (Co-operation).

Acknowledgement

By signing the Rental Contract or taking possession of the Car, the Renter confirms having read, understood and agreed to these Terms & Conditions.
